In an interview with the High Council for Human Rights, Dr. Seyed Mohammad Hossein Payghambari, a judge at the judiciary, discussed the new literature made by the judicial security document which was issued by the Head of Judiciary a while ago.
Payghambari said that since the judicial security document is based on the policies made by the Supreme Leader, it can be said that after the constitution of the Islamic Republic of Iran, this document is among the high-positioned instruments and all sections of the judicial system have the duty to obey it.
“This document is a policy maker one and one should not expect such an instrument the features of an instrument with subjective laws. Therefore, considering the aim this document has, one cannot define a guarantee for its enforcement for the nature of this document contains the duties which are assigned to different parts of the judicial system”, Payghambari said.
Considering the importance of public rights, the judge said that fortunately this document has paid attention to the public rights and safeguarding them which is the novelty of the mentioned document.
Another novelty made by this document is with respect to inmates which is also an issue discussed internationally. The rights of inmates including having access to hygiene equipment and going on furloughs and particularly informing judicial officials of the strikes at prisons are creative approaches taken by this document, he added.
“The last point which I think should have been predicted by this document is the security of judges who execute the laws. Certain strategies should have been determined in order for the judges to feel secure while doing their job for the judicial security would be imperfect without the security of judges”, Payghambari said.
