HCHR_Kazem Gharibabadi, Vice President of the Judiciary for International Affairs and Secretary of the Human Rights headquarters in a joint meeting to rewiew legally the criminal actions of the Zionist regime, which was held at the General Secretariat of the International Conference for the Support of Palestine, referring to the new round of attacks by the Israeli regime, recent attack on the Gaza hospital, considered it an unprecedented crime and said: This round of attacks by the Zionist regime is a combination of various crimes against the defenseless people of Palestine and Gaza, and these crimes fall under the jurisdiction of the International Criminal Court.
Gharibabadi added: In the 12 days since the war by the occupying regime against the Palestinians started, we have witnessed all international criminal crimes such as war crimes, crimes against humanity, and genocide. The regime officials also adopted positions that can be classified as international crimes.
Referring to the Rome Statute, the Secretary of Human Rights said: Threatening that no one should be spared is one of the specifications of the crime of genocide. The criminal actions of the Zionist regime make the responsibility of the Islamic Republic of Iran and Islamic countries as well as international organizations very heavy. Islamic states must take practical measures.
He added: Western countries and the Zionist regime are now waiting to see if the Islamic countries will decisively and practically support the Palestinian people or if they will prefer to be a mere bystander! The role to play by the Islamic states in supporting the Palestinian people is key and vital.
The Vice President of the Judiciary for International Affairs then put forward some key proposals for the follow-up of the lawyers and their relevant demands from their partner countries and organizations and institutions in the international arena and said:
First point; It is the responsibility of the Human Rights Council to hold an emergency session and there is a question here that why has the emergency meeting not been held in spite of that a few days have passed since this tragedy? The second point is the necessity of the interference by the U.N Security Council as well as the General Assembly in this issue aimed at issuing an immediate ceasefire resolution and sending humanitarian aid to Gaza and allowing access to water, food, fuel, electricity, medicine and medical equipment. and the third point is that the request and demand for an arms embargo on the Israeli regime has to be offered by the whole legal community.
Gharib Abadi considered it very important to use the capacity of the International Criminal Court regarding this issue and said: The Palestinian government is a member of the Rome Statute and the court has the jurisdiction to deal with the crimes of the Zionist regime. Therefore, he added , the Palestinian government is to defend its people and documents of crimes need to be must be collected. He opined Palestinian groups, lawyers, and non-governmental organizations should manage to document.
The Secretary of the Human Rights Headquarters also said: Another point from the legal aspect is the follow-up the issue in foreign courts. The Zionist regime officials travel to some countries and these officials can be prosecuted through the courts of those countries. Lawyers must put pressure on these countries.
Another point that is very important is networking in this matter. The capacity of the Association of lawyers, jurists, judicial experts center, university professors and non-governmental organizations should be activatedand used, since they can play a key role in building a network with the lawyers of other countries for the purpose of supporting the Palestinian people. As a final approach for this purpose, he referred also to the capacity of using people's courts .
