  • Three agreements between Iran and Iraq, from ensuring prisoners' dignity and health to pursuing Baghdad assassination

During the visit made by Ayatollah Raeesi, the head of the judiciary to Iraq, three memorandums of understanding were signed between the judicial officials of the two countries , High Council for Human Rights reported.

After a formal bilateral meeting with the Chairman of the Iraqi Supreme Judicial Council in a press conference, Ayatollah Seyyed Ibrahim Raeesi said that during the talks between the Supreme Judicial Councils of Iran and Iraq, three official memoranda of understanding between the Ministry of Justice of Iran and the Ministry of Justice of Iraq, the Attorneys General of the two countries, as well as Iraq's Disciplinary Organization with the Inspection Organization of Iran were concluded  which is hoped to bring the relations between the judicial systems of the two countries closer and closer.

Given the mutual legal-judicial cooperation between Iran and Iraq, these three memoranda of understanding are of great importance.

 

 

Memorandum of Understanding between the Iran's Bureau of Prisons and the Iraqi Ministry of Justice

This agreement has been signed in order to respect the Islamic and human rights of detainees and prisoners and to transfer legal experience, the procedures and technical achievements of the two countries.

In the thirteenth paragraph, the parties agree to protect and respect the rights and dignity of prisoners, transfer experiences in reducing the number of prisoners and their exchange, rehabilitate prisoners and provide the necessary conditions for their return to society, protect the health of prisoners and prison staff , especially in the face of the outbreak of the coronavirus, and they  have also been required to visit prisons and check the status of their nationals  along with special facilities such as family contact.

 

 

Joint Action Plan between Inspection Organization of Iran and Iraqi Disciplinary Commission

Also, in order to develop operational cooperation and implement the provisions of the Memorandum of Understanding (approved on March 26, 2016) concluded between the Inspection Organization of the Islamic Republic of Iran and the Disciplinary Commission regarding exchange of experiences, holding online training courses, establishing a communication line between embassies and the consulates of the two countries to handle the complaints of the citizens.

 

 

Judicial cooperation between the Iranian Judiciary and the Iraqi Supreme Judicial Council

Following the official visit made by Ayatollah Raeesi, a memorandum of judicial understanding was signed in the framework of the jurisdiction and authority of the parties in 20 paragraphs and based on the principles of equality and respect for the sovereignty and territorial integrity of the two countries.

 

In this memorandum, the two sides, while condemning terrorism in all its forms, especially the terrorist crime at Baghdad airport, stressed the authority to investigate this crime, to cooperate  with each other in conducting investigations, identifying, prosecuting and punishing commanders, deputies and the leaders of this inhumane act.

Also, since the two sides have been victims of various terrorist acts, including the crimes of the hypocritical terrorist group ISIS and other terrorist groups, they agreed to pursue the perpetrators and supporters of terrorist crimes and defend the rights of victims in national, international courts and forums.

In other clauses of this Memorandum of Understanding on the application of Islamic compassion, granting amnesty to those convicted of general crimes, responding to requests for judicial assistance and extradition of criminals and removing obstacles, transferring their experiences and achievements in the field of protection and promotion of human rights, fight against corruption and terrorism, workshops on women's, children and adolescents' rights,  training courses and student-professor exchanges between Iran University of Judicial Sciences and the Iraqi Supreme Judicial Council Training Center, defending human rights using existing capacities in the Organization of Islamic Cooperation, Human Rights and International Forums were realized in the framework of the two countries' competencies.

These three memorandums of understanding were signed in two languages of Persian and Arabic, on Tuesday, February 9, 2021 in Baghdad.
